Abstract

The legislation of the principle of a legally prescribed punishment for a specified crime cannot be separated from the scholar's creation and rectification. In a sense, the legislation of the principle of a legally prescribed punishment for a specified crime is interrelated with the social actual structure. In China, with the rise of civil society and growing up of dual social structure, the principle of a legally prescribed punishment for a specified crime has finally been legislated.
