Abstract

Starting from a review of the theories and current situation about the legal position of institutions of higher learning,this paper analyzes the theoretical misconcept and realistic problems and discusses the education rights of colleges and universities.It holds that their legal position depends on a wide range of social functions in our country and on the legal characteristics resulting from the social functions.
