On construction of civil retrial legislation in China

The retrial procedure stipulated by the Civil Procedure Law of China plays an active part in correcting wrong sentence and maintaining the rightful interests of litigant,but the exertion of its actual effect is far from satisfaction,and some defects still exsit in it.Along with the further reform of trial method and the perfection of lawsuit institution,as well as the enhancement of legal consciousness of people and the advancement of ruling the country according to law,it is necessary to reconstruct the civil retrial procedure in China,and to construct relative legislations of retrial lawsuit,so as to regulate the retrial lawsuit and establish the civil retrial legislation in accord with the general characterastic of lawsuit.
