Abstract
In the individual income tax law of USA the individual income is divided into four categories: earned income,unearned income,transfered from others and imputed income.At the same time,in the rule of passive activity losses of USA the income is divided into three categories: portfolio income,active income and passive income.Some regulations based on the two means of dividing have an effect on individual tax burden,which is beneficial to the justice of tax burden and the prompting of labor provision.These two dividing means and the related regulations should be studied as a reference in the improvement of the individual income tax law of PRC.
