Feasibility of Medical Association to Carry Out Technical Appraisal of Medical Damage

For a long time,all levels of Medical assume the functions of Malpractice,but there are also some problems. A variety of factors led to the existence of two-tier phenomenon on identification. After the implementation of Tort Law,in the civil sphere as medical harminstead ofmalpracticeconcept,community on the Medical Association identification functions into question. Currently at the national level did not give an authoritative and clear answer,as a result of this issue hesitation and confusion in practice. As a transition,all levels of Medical Association should be introduced the temporary regulations at this stage,maintaining Medical Association to continue to exercise the functions of identification. In future,the damage identification system should be harmonized. However,medical experts should not be easily denied,should still assume a major role in the damage identification.
