Abstract
The right to education is one of fundamental human rights,freedom and the constitutional rights,and the government is the compulsory subject who guarantees the civil right to education to become true.These are the basic thoughts of international laws on the civil right to education.But there are some inherent deficiencies in the provision of citizen having the right and obligation to education in the Constitution of China and this provision is also out of accordance with the thoughts of international laws,so it is not good for people to enjoy their rights to education.We must resurvey the basis of law and amend our constitution and laws,so the civil right to education can be really ensured by law.
