On Legal Theoretical Analysis of Civil Society

As a result of the development of democratic politics, civil society separates itself from political state. The term, civil society, gives fresh impetus to our law science research in China, and not only can be used as a fundamental term but also as a technical term i.e. independent private life in our civil and commercial law science research. The meaning of the subject of modern civil society is close to natural person, but not traditional peasant and citizen in public law. Autonomy of private law is also in accordance with law. Civil law as the general private law of civil society promotes development of China civil society and lays the natural foundation of the legal society of China. Civil society as a kind of restriction on political power conversely depends on political state. The both sides join with each other to form a dialectical development course.
