Abstract

The Indian Patent Office has issued draft guidelines which may amount to ‘law-making’, considering the limited level of jurisprudence available in India and, to this extent, the guidelines may appear to make the test of patentability of computer implemented inventions in accordance with the practices of the European Patent Office and, in certain cases, more stringent than intended.
