Abstract

The paper presents the steps taken by the Interstate Commerce Commission (ICC) to lay the groundwork for labor protection in small railroads. The Interstate Commerce Act has two sections which are relevant to this issue. The first one, 49 USC 1091, applies to acquiring lines of railroads. Labor protection is optional in this section. The second section, 49 USC 11343, applies to combinations of railroads when railroads buy each other or combine. Labor protection is mandatory in 11343. Examples are presented, and reasons are given for whether the interactions come under 10901 or 11343.
