Abstract
The purpose of this note is to investigate whether the National Credit Act 34 of 2005 regulates the payment of school fees charged by public schools. Although the answer seems to be self-evident, it is not. Therefore a cursory analysis of the liability to pay school fees, the definition of school fees, the requirements of a credit agreement and the applicable credit agreements is undertaken. The sections of the National Credit Act that could possibly apply to school fees are pointed out.
