Tolkmissar ett hot mot rättssäkerheten - Ett kunskapsbaserat dilemma?

Today communication through an interpreter at authorities is a common phenomenon in Sweden because there are people living in the country who do not understand or speak the Swedish language. This paper focuses on the use of interpreters in the judiciary and how the interpreter misses in this occupation may threaten the rule of law. The purpose of this paper is to investigate if the current interpreter system can guarantee everyone the right secure equal treatment. Previous research has, inter alia, noted interpreters varying level of knowledge which also the majority of the country´s courts have pointed put. To further illustrate this problem the paper also analyses if there are other factors than the interpreter's knowledge that are affecting the law of a fair trial. The interpretation system that this paper assumes is based on three operations; education, interpreter services and interpreter users. Different kinds of interviews have been implemented with respondents in all of these operations to get a conception of how they see the current interpreter system and it’s legal.
